Legal Question in Bankruptcy in Maryland

Fraudulent Bankruptcy Filing

I am a 54-year-old disabled shut-in. I recently found out (via my credit report) that three years ago, my now-estranged husband (to whom I was not yet married), who is under investigation for identity theft, bank fraud, and tax fraud, filed CH 13 bankruptcy in my name but without my knowledge or consent. I haven't been able to find anything in the Maryland Code to help me know how he would be charged for this. So far, for the other things, it is 30 counts of misdemeanor fraud and at least 3 counts of felony fraud. Is there a law against filing bankruptcy in someone else's name (to escape paying rent) without their knowledge or consent? My credit is ruined. Thank you very much.

Re: Fraudulent Bankruptcy Filing

It would be a federal crime of bankruptcy fraud. Contact the FBI or the US Attorney's Office.

Re: Fraudulent Bankruptcy Filing

From what you are saying, it sounds like a Federal Bankruptcy Fraud case. You can start by contacting the Bankruptcy Trustee who was assigned the case and the FBI's Bankruptcy Fraud Unit. I wish you the best in resolving this matter. Legal Advise and Representation may be obtained by making an appointment to come in for a free consultation: (301) 279-8773.
