Property Lien found after bankruptcy filed
I was trying to refinance my home and discover that a lien was place on it in 1995. The lien was due to hospital bills related to an motorcycle accident I had in 1985.
The lawyer who handle the accident case is dead. When the accident case went to court my lawyer settled for 10,000. Of that 10,000, 6,000 was suppose to be paid to the hospital and the remaining 4000 was his fee. The hospital bills were for 15000. He was also suppose to asked to have the remain amount waived due to the settlement amount.
The lawyer who placed the lien on my property claims that the accident lawyer never submit any payment to the hospital. I never received any notification of the judgement for the lien.
I filed a bankruptcy in 1998. When I filed, I was unware of this situation. Would this be covered under the bankruptcy I filed or is it exempt?

I've seen this happen a few times. Question: WHen you filed (I assume a Ch 7) did you own the home? Was the hospital debt due and owing? Why was it not scheduled? Did you know it was in collections and did you get notice of the judgment? What you may have now is a "judicial" lien, question is when was it put on the property, before or after your discharge. Dear Rosanna, Forgot to ask you abt. the property title, is it titled only to your brother? I am hoping his wife's name went on the title too. I sent you a letter today.
