Breech of contract?

May of 2006 I received a quote for a vehicle transport between Maryland and Montana. I accepted the quote and made the requested deposit. It is now August and the vehicle is still in Maryland. I was told today that there is hardly ever a driver going to Montana. This was never told to me when I made the contract, when I questioned the fact that if they knew Montana was a limited state why did they make the offer, I was told they could refund my deposit. I told them I want they to fullfill their end of the contract. I want to know if there is any thing I can do to get them to honor the contact.

I'm assuming that you have nothing in writing spelling out the terms of the agreement to transport your vehicle. Unfortunately, apparently you didn't discuss with the company the timing element of delivering your vehicle. Your best practical solution is to find another way of getting your vehicle there, and do it that way. If you incur significant additional expense, you might have a legal claim to recover the difference from this company, but you would have to prove that they failed to fulfill their part of the agreement within a reasonable period of time.
