civil lawsuit

I was the principal financier of a tow truck business witha friend. The original agreement was that he began to repay me on the money loaned August 2006. I also made a personal loan with him of approximately $15,000. I need to know how do I begin to file a lawsuit against in order to either retrieve the trucks or repayment of money loaned?

You will commence collection on the personal loan through a complaint filed with a court of appropriate jursidiction. The process involves serving the complaint, appearing at court, and presenting your case. There are a couple alternatives with preparing the complaint.

As to money loaned for purchasing vehicles you may be able to file a lien against the vehicles to protect your interest. Repossession may also be an alternative. Otherwise, you can file for a judgment and then execute for sale or ownership of the vehicles.
