Competition clause

I signed a non-compete as condition of my employment at my former company. While at the company, I was told to pay workers illegally using questionable methods. Knowing this, am I able to start my own company without being bound by this agreement since I was asked to undertake illegal activities? The illegal activities had to do with payment of overtime. Thanks!

On its face, your contract may be binding even though you were asked to do things that were illegal. Having said that, if you can prove the things you are talking about, you probably have some leverage to negotiate a release from your no-compete agreement.

you almost certainly want to get an attorney and work this out before you go off and start a competing business.
