Legal Question in Business Law in Maryland

Can I File The Same Civil Suit In Two States?

I live in Maryland. The Respondent lives in West Virginia. The contract is binding to West Virginia law. I have filed in West Virginia already. My question is, as a legal strategy to get a default judgment...can I file the civil suit in my home state of Maryland at the same time, since that's my main residence?

Yes, you can file, but "as a legal strategy to get a default judgment," it's not a great idea. If they have counsel in WV, it is certainly not likely they will default in MD. And it is almost a certainty that the MD court will stay or dismiss the case based on the prior-filed WV case. So you will have just wasted money. It would not be at all surprising if this strategy had the effect of upsetting the WV judge as well. Generally a bad idea.
