Legal Question in Business Law in Maryland
filing a civil lawsuit against a corporate vendor in Maryland if they are located in Massechusettes
1 Answer from Attorneys
In order to sue a corporation located outside of MD in our courts, you must be prepared to demonstrate that they have a significant enough presence in MD to establish jurisdiction over them. If they have no physical presence in MD, you need to demonstrate that they do a significant part of their business here. If they advertise in MD-based media, that might be sufficient. In your particular case, if there was contract between you that was executed in MD, that will probably be sufficient. On the other hand, if the business relationship was done electronically or off a website, and all they did was ship goods to you from out of state, you probably will have to sue them in MA. You should consult with an attorney who can evaluate the particular facts of your situation to better advise you on where to sue.
