Firing for marijuana use

I have an employee who was in an accident with our work truck this past Tuesday. He was charged with the accident. He was also arrested because they said his license was not revoked. (We did not know.) We had him tested for post accident drug testing. His test came back showing marijuana use. He told us he smoked marijuana two weeks ago. We want to fire him because of the accident - the truck was totaled. We have a drug-free work requirement. Can we legally fire him?

Unless your company has some kind of grievance procedure that allows him to challenge disciplinary action, he's nothing more than an employee who serves at the pleasure of the employer, and can therefore be fired at any time.
