Legal Question in Business Law in Maryland

identity theft-false credit card application

in 2001, I got involved in a business venture.recently I checked my credit report and found out that I had over $12,000 in credit card debt that had gone into collection. I then found out that this company had opened a credit card business account in my name with my SSN without my knowledge.the statements were sent in MD and I live in TX. here comes the hickup. at some point in time, they told me that they were going to add me as an authorized user on one of their business credit card for me to be able to cover some expenses and , upon receiving the card, I used it 2 or 3 times for an amount totaling less that $200.

but I never knew the account was opened with my information. I never received a bill

How do I clear my name and get this bill off my credit report? I've filed a police report.

Thank you

Re: identity theft-false credit card application

I would first try to get copies of the credit application from the credit card issuer. If they have a signed application, you should be able to establish that you didn't sign for it. Then contact the 3 credit reporting agencies and send them documentation of what you received from the card issuer. You weren't clear in your question as to whether the card with the $12k debt on it is the same card you used a few times. If so, that will complicate matters since you signed for that account. Clearing up an incorrect credit record is never easy, so this may take some time.

I beleive you are posting this question for the second time. Please review my prior answer.

Unless you consented to the debt in some manner they will not be able to collect. The statute of limitations may be running out on your defense. You should hire an attorney.
