Is it legal to record a church board meeting in Maryland?

Maryland law prohibits the "interception" of "communications" without the consent of all persons to the communication. This does NOT mean that it is illegal to "record" or "tape" someone without their consent in Maryland. The words "tape" and "record" are conspicuously absent from the statute.

You are encouraged to consult with a Maryland barred attorney before tape recording any conversation or meeting surreptitiously - depending on the circumstances, this can cause problems! That being said, board meetings must have accurate minutes (or records). If one questions the accuracy of the minutes, one may suggest that a temporary tape recording of each session be made until the secretary is able to prepare minutes for circulation. The board could have a policy that once minutes are prepared and circulated the temporary tape is destroyed.
