Legal Question in Business Law in Maryland
What license do i need to start a property menagement company in Maryland
1 Answer from Attorneys
Leasing is considered "real estate brokerage" work. Unless you fall under an exception, one needs a real estate license to do brokerage work. That being said, Maryland law currently allows non-licensed property managers working on behalf of owners some leeway to manage / lease real estate for the owners. Our state does not have a specific property management license. However, the law in this area may be changing -- there has been a recent push in this state to add specific PM license requirements.
Besides industry specific licenses, a new property management business will usually want to form an entity and register the entity and any trade name with the state. Depending on the area and other details, you may need to file other registrations (some Maryland counties require registration for certain home based businesses, etc.)
My law firm is located in AA County but serves businesses throughout Maryland. I have helped other property management companies in Maryland start up. If you'd like to get more specific information about starting a new business you are welcome to call 410-216-7000 for a no cost initial 10 minute attorney telephone consult. While this post is not a substitute for legal advice, I hope the general information helps.
