Legal Question in Business Law in Maryland
rented a generator for the caribbean festival. got the generator and it did not work, company sent technician who was unable to fix it. because of the generator not working I was out 3500 dollars, the cost of participating in the festival. can I recoup those losses. should I contact company for resolution, or should I go straight to small claims court. the event was 5 months in maryland.

If you signed a rental agreement, you will probably find that it limits the rental company's exposure to a refund of the rental fee, in which case they would be able to successfully defend against a small claims suit. If you aren't restricted by this, and you can demonstrate that you had no ability to replace the defective generator with a working one in time to participate in the festival, you will probably have to go to small claims court because it is highly unlikely the company will voluntarily reimburse you. But you have nothing to lose by requesting reimbursement.
