Legal Question in Civil Rights Law in Maryland
Could a school violate their cell phone usage policy. Their policy states that the first offense will result in a warning, the students parents will be called, the cell phone will be confiscated and returned to parent, and a conference would be held. Can a school skip from a first offense and move to the disciplinary action for a second offense?

It depends. Sounds like you are leaving facts out. Schools are generally required to follow their own written procedures in disciplinary cases, but there are usually extenuating circumstances. In other words, was the violation not simply for cell phone usage, but something else as well?
