Because you are both on the mortgage, you are still responsible to pay your portion of the mortgage. You can force the sale of the house if that is in the best interests -- it may not be depending on the value of the house and what is owed. I am presuming she is seeking contribution to the mortgage from you in her lawsuit. She will likely win the contribution, but you can, again, force the sale of the house. You may be able to negotiate the contribution. You should speak with an attorney. Feel free to contact me if I can be of assistance.
