Legal Question in Civil Rights Law in Maryland

During spring break a young man was smoking marijuana in the room above my son and his friends. The local police smelled the smoke and entered the room of my son and the man who lived above him. After searching the mans room they confiscated 1lb of marijuana and arrested him. They retrieved nothing from my sons room and my son and his friends did not know nor speak with the young man. The hotel assumed because the room was searched that my son and his friends were involved so they were evicted from the hotel and denied a refund of the room charge. I would like to know what legal action we have against the motel

Your can file a lawsuit in small claims court against the hotel for breach of contract. Your son paid for something (occupancy of the hotel room) and was denied the use of said room. The hotel does not get a windfall when it decides to kick people out.
