Moving Claims

I hired a moving company to move my household goods from MD to CA. Their company provided insurance in the amount of .60 per lb of the shipment. I expect maybe some minor damage and scratches, but upon delivery most of my furnishings were demolished, a desk beyond repair and boxes listed on the inventory were missing. The estimated damages are $5,000. The company didn't sent me any claims paperwork, but told me to send the photos and the estimate to them. They offered my $1,000. and asked that I sign a release. They never took my shipment to the weigh station so they cannot determine the weight of the items. How can I recoup my losses from this company. I paid them over $9,000 for the move.

i empathize with your situation, as i too have had moving company nitemares in the past. you or your attorney should send a demand letter to the moving company in an attempt to settle your very valid claim out of court. if the company is uncooperative, then by all means haul them to court immediately! if you need additonal legal advice, assistance with your demand letter, or information on where and how to bring about a potential lawsuit against this company, do not hesitate to email me for further help.

I have provided information about the law with respect to your matter in the past (see my responses on LawGuru) and my experience shows that an attorney's assistance is usually required to resolve matters where there is a genuine claim. Your matter, as discussed, appears to present a genuine claim. An attorney's demand usually obtains more consideration than a layman's letter which often fails to properly lay out the legal issues. You will have tocheck if they are registered to do business in CA. This at the Sec. of state. If not you will have to sue in MD
