Legal Question in Consumer Law in Maryland
Payment of back balances
I have not received a bill from a certain cable TV company in about 6 months. I have contacted them 4 times to inform them of this. My question is when they finally do catch their mistake can I be legally responsible to pay the balance for the 6 months?

Re: Payment of back balances
If you used the services under a valid contract then you
are required to pay for the services used. If there is a billing matter, you may
be charged late fees and interest where provided for in the contract. As always, oral
conversations are of little probative value where a dispute arises. You may want to consider sending
registered mail to inform the company of the issue.
Re: Payment of back balances
Since you have knowledge that a periodic payment is due to the cable company, you will be held liable. The issue is not whether you receive a bill from the cable company. The issue is whether you agreed to pay them for service. This promise to pay is infered from the fact that you have an account with them, are aware of the account, and receive and use the service. If you wish to watch the Super Bowl this weekend, I suggest that you make arrangements to pay as soon as possible.
