Unauthorized cancellation
Our daughter was killed in an accident three months ago. She and her four year old son lived with us. the father of her son had her cell phone shut off the morning after the accident. At the time, I was unaware he had done this. When I ask him later on, he said yes he had done it because my family ask him to. They deny this. We also had put my brother in charge of handling everything for us including communicating with police, her employer, bank accounts, ect. She was killed in a MVA while working. The cell phone company admits they shut the phone off on his word.
The problem is we are now in a custody battle and have since learned of some threats he made to her. We now believe he had the phone shut off to prevent us from finding threats he made to her by voicemail or text messaging. What recourse do we have against the cell phone company. It makes me so angry that this is evidence we might have had to secure our grandsons safety.

If you have a custody case going, and have subpoena power, you can subpoena phone records from the cell phone company.
