Legal Question in Credit and Debt Law in Maryland

Certified Used Car - Can I return?

I bought a certified used Acura MDX from an Acura Dealer on September 19th. On September 21, we discovered that the DVD player was broken (it was under warranty) AND that there were small white worms in teh back area of the SUV. We called the dealer (75 miles away in a neighboring state) they said bring it back and they'd fix it. They were very nice. We took it back on Sept. 24th, they said they took the back apart, found more bugs, sprayed and cleaned. (they also replaced the DVD system) We picked it up on Sept. 27th, on Sept 28th, one of the dealer-installed new tires blew as a result of improper installation. (we got that in writing from the tire store) and today, Oct. 1, I found more live worms/larva in the back.

I want to just take the car back to them and be done - or have them find me an suitable replacement. I bought a certified, luxury SUV - I think it's implied that there would not be a bug infestation. What are my rights?

Re: Certified Used Car - Can I return?

I agree, the certification should not include worms. Not sure these issues are significant under warranty law, but the worm issue is bizarre. You should ask them to refund or replace it, if you have not done so already. If that does not work, you will likely need to hire an attorney to obtain a satisfactory result.

Good luck.
