Legal Question in Credit and Debt Law in Maryland
Collections Question
What are the proper steps of collecting funds from attorneys where their clients rendered physical therapy at our center. We have been trying to collect funds from over 100 patients and we found that most of the patients have settled their cases but we were never reimbursed for our services. The attorneys are always giving us the ''run around'' and this has been going on for about 3-4 years now and in some cases longer. We do have a a irrevocable covenant that the patient signs and that is placed on the back of each page of the medical and physical therapy bills. I just wanted to ask, should I get a collections attorney or what other steps can I take. Thank you!

Re: Collections Question
I would hire an attorney or place a lien on the settlement once you know that there is an attorney involved. IF settled, then you can always sue the client.
I would be happy to discuss your matter further, if interested contact my office for a consultation.
Re: Collections Question
Most medical providors who treat accident victims require that their patients (and the attorneys who send them over) sign an "assignment" before they start treating which essentially makes the attorneys themselves liable if they settle the case and collect money but don't pay the medical providors. If you don't already have that, then you need it right away.
Most providors also retain rights to go after their patients directly as well.
You should probably consult with an attorney to make sure that you get paid for the cases that you have already treated, and to make sure that in the future you are properly protected if you are not already.
I represent many physicians and medical practices and would be happy to chat quickly with you on the phone to give you some ideas about where to go, how much it would cost and what your chances of recovering are etc?
