Gym Membership fee issue
When I lived in MD I joined Transformation in Odenton, an all female gym (3/2004). When my husband was trasferred to Ft Gordon Ga I took a copy of his orders to the gym and they let me break my 3 yr contract since GA didn't have this gym there. I was told I just had to pay for the month of Oct (10/5005) and I was done. I had a signed letter from the gym and it slipped my mind after moving here to send the payment of $55. I get a call from a col. agency asking for $1300 for the remaining 3 yr contract. I said I had the letter and faxed it to them. Now the gym is saying the want me to pay through 3/2006 because I waited on the letter and this will cost me $278 to do that. Is this legal if the letter never said it had to be paid by X date? I can't work due to muliple health issues. I didn't even use the gym that much after I started having health issues.

Based on your post, they have a valid argument. You had a deal to resolve it with a payment of $55, and you failed to finalize the deal with a payment. Therefore, since the contract was not terminated according to the new agreement, the monthly charges kept running. Your argument that the letter did not have a date on it is very weak, as it is you who did not follow through. It is logical for them to keep the tab running until you pay.
This is based on what you posted, so maybe the letter, contract or other facts are relevant and would lead to a different outcome. Barring that, negotiating a settlement with them for some amount is better than a bigger hit on your credit report, given your negligence and the amount involved.
