Harassment

A lawyer accused me of fraud in a bankruptcy proceeding in his effort to collect a bill for a credit card company.The file,over a 9 month period is 1 inch thick.

1.Can I sue him for libel based on the fraud charge ?

2.Can I sue him for harrasment on the basis of his persisten bill collecting activity via the court proceeding ?

3.Can I sue him for abuse of the judicial system in his bill collecting activity ?

1. No. Statements made in court are immune from suit for libel. 2. If the court proceeding was in bankruptcy court, he's free to pursue it, and you can't sue him for it. 3. You can't sue for abuse of the judicial system. If there is no basis for the fraud claim, you can try to seek sanctions under Bankruptcy Rule 9011.
