Hello,
I have loaned out $2900 to someone, in which they have paid $400 of it back. Can I sue if they are not consistently paying me each month when they agreed to it in our contract? And if so, if I win the case, how long after will it take for me to receive the money from them. Will it be the total amount in full?

You can sue for the balance owed. But, winning the case means that you receive a judgment. A judgment does not mean you automatically will be paid. A judgment will allow you to pursue certain legal remedies to seek payment, such as garnishment of wages or garnishment of property or bank accounts.

You can sue for the total amount owed in small claims court. Once you obtain the judgment, you will have to pursue the judgment through garnishments and liens (among other things).
