Legal Question in Credit and Debt Law in Maryland
Settling a garnishmnet/judgement
I had a judgement filed against me 10 months ago. The original credit debt was roughly $5000, but with associated fees and interest, had become nearly $11,000. A garnishment was attached to my weekly paycheck and is currently being withdrawn (bringing the balance now to $9200). I want to come to an agreement/settlement with the collection agency, but they are giving me a difficult time. They say that they do not settle on garnishments, but I would think that a settlement would do us both good. I warned them that I might be laid off, but they want my supervisor to call them to confirm this. However, I do not wish to bring my business life into my personal life any more than it already is. What should I do? I am not trying to avoid the debt, I just don't want to pay $11,000 for a debt that should be half of that amount. Is it reasonable for me to offer them $6000. They have already collected almost $2000 from me. Any information would be appreciated.

Whether they settle where garnishment is active and in place is a business decision for them. There is no way to force them to settle; however, there are advantages for them to settle. You need to be careful to ensure that the settlement conforms to law so that you accomplish the objective of being free and clear of the obligation to pay the full amount.
