Is there any legal recourse when an "alleged law office" sends threatening email to my computer in attempt to collect a debt?
1 Answer from Attorneys
Assuming that the sender is not a law firm but is falsely posing as one, then, YES, both federal and state law offer possible remedies. The Fair Debt Collection Practices Act (FDCPA) outlines remedies for abusive collection practices, including pretending to institute suit or misrepresenting that the collector is an attorney / law firm.
If an attorney in the course of normal representation contacts you, then the analysis may vary. A law firm engaged principally in debt collection needs to follow the rules for debt collectors, including registering with the state, while some contact in the context of litigation or other representation is fine (even if it threatens suit) and doesn't need the same language as a third party debt collector contacting a consumer.
The above general legal information does not create an attorney/client relationship or offer specific advice about your situation. You may wish to have an attorney review any correspondence you received.
