Legal Question in Criminal Law in Maryland
2 degree assault on a minor
My spouse was charged with 2nd degree assault involving a minor. This was a result of a 'non-sexual touching' while moving the sleeping minor to cover them up. This is going to trial.....can an additional sexual type of charge be added after the fact or at the trail? We don't want to put the minor or ourselves through this.

The State would have to provide notice prior to trial of additional charges.
