Legal Question in Criminal Law in Maryland
Assualt and Battery?
I was recently at a party with some friends. I had a few beers and passed out on the couch. My face was beaten in by a man whom I have heard of but do not know personally. Police have 4 witness statments including mine saying that the gentelman did this. I have suffered a broken jaw in two places and an orbital fracture around my eye. My jaw will be wired shut for next four weeks with me only being able to drink liquids and drink protien shakes. My question is... What should I do as far as settlements are concerned, how much should I expect to get for a case like this? And about how long will a case like this take to settle. I know my questions are very general, so I will be expecting general answers, but i would like some kind of somethign to go on as the best way to approach this.... thank you everyone.

Re: Assualt and Battery?
Generally, cases are submitted for settlement once treatment is complete. It does not look like you are finished treating. You have to file a complaint with the court if within certain time limits so if you were not done treating and the time limits were approaching you would go ahead and file a complaint with the court. Once you finish treating the adjuster for the person you are brining the claim against will review the records and usually get back to you or the attorney representing you within 30 days with an offer or let you know they are denying liability. Potential claim against homeowner, person that had the party, and the person that struck you. Would need to know more about the specific circumstances. Settlements and judgements on verdicts from the court vary and there are numerous factors that go into the amount you would get. Attorneys generally look at the total medical expenses in coming up with a figure to request. If you want to discuss further please feel free to contact me at [email protected].
