Bad Check From Closed Business

A check I wrote from a now closed business I owned did not clear. There are no funds. The state wants to prosecute me (actually it says the company) for writing a bad check. What do I do?

All prosecutions are done by the State. The victim of a bad check are not suing you, but acting as a witness for the State. A criminal conviction for writing a bad check includes fines and possible jail time. Because of the seriousness of the offense, you should IMMEDIATELY contact a criminal lawyer (me for instance). There are certain rights you have as a criminal defendant, but there are short time limits and that is the reason you need to talk to a lawyer NOW.
