Caught stealing now what?
The other day i was caught at a local walmart stealing a $2.00 item. They had a police officer come and all. They said I will recieve a bill of restitution in about two weeks. After that will I have to go to court or will everything be dropped. They said court at walmart but I want to get a professionals opinion on what exactly will happen to me. I apreciate any reply or input. Thank you so very much.

Wether or not you have to go to Court after stealing from a store is up to the store. It always good advice to employ a lawyer before you admit to anything. A theft conviction will last the rest of your life, don't screw things up for yourself because you think it will work out to your benefit.

Contrary to common belief, whether the charge will be pursued to conviction is a decision for the State's Attorney. This will depend on many factors including the level of police involvement and ability of coordination with the entity making the charge(s).
Monetary restitution is the civil remedy for the alleged act. Criminal charges may additionally be pursued. Restitution may also apply to criminal matters but do not confuse this with civil restitution (i.e., the civil remedy). Criminal restitution is in pursuit of the objective that the wrong doer recognize the wrong and aimed at ensuring the behavior will not be repeated.
Given the small value of the item in question, you stand a good chance that the matter may not lead to a criminal charge but this does not mean that you should not be represented since the police were involved. Obviously you would be better off where the charge(s) are not pursued for conviction and this may necessitate action on your part now.
