False Allegations

An incident occurred between three people, a police report was filed. Person A, came to the residence of Persons B and C.Persons A and C engaged in a verbal dispute.Person A admits in police report to forcefully entering the residence of Persons B and C,pushing Person C and ''accidentally'' striking person C in the face.Person A also states that Person B then ''got in between'' them.Person A also states that Person C stood in front of the door, in what

Person A saw as an attempt to be kept in the house. Person A claims to have had to push Person C out of the way to

exit the residence.Person C filed charges against Person A for 2nd Degree Assault.The day after receiving these charges

Person C filed charges against Person B.In the description of the incident to the commissioner,Person A claims to have ''walked'' into the house, pushed Person C, and then been grabbed by the arms from behind by Person B.Person A claims that she begged to be let go, screamed and cried, and after app. 5 minutes of being held by Person B, broke free of their graspand ''escaped'' the residence. In the police report Person A makes no claim of any maltreatment by Person B.

Is it likely this case will be prosecuted?

Re: False Allegations

The complaint involves three people. Assault charges are not yet levied. Serious physical injury is at issue and whether there is evidence to show an intent to cause or attempt to cause substantial risk of death, disfigurement, or loss or impairment of a function of the body or organ. Penalty for second degree is not more than 10 years or $2,500 fine or both. Contact an attorney immediately if you are charged with a criminal offense.
