Legal Question in Criminal Law in Maryland
I have a friend who was sentenced to 30 years, with 16 suspended for 2 counts of 1st degree burglary in Maryland. If the max sentence is 20 years, what can be done about this?

A judge can sentence up to the maximum on each count, and that would not be an illegal sentence. Thus, 20 + 20 consecutive = 40 years. However, he can certainly file a motion to reconsider sentence (deadline within 90 days of sentencing) and ask for the sentence to be reduced. The protocol is to file the motion within 90 days and then ask for a reduction in sentence some time after that.
