Legal Question in Criminal Law in Maryland
home detention
my husband has a record already and is accused of 3 counts of theft +500, malicious dest. -500, mal dest. +500, burglary 2, and assault 2 on law enforcement. the one mal, and assault is cause he tried to get officers attention and window broke, the other is from guys stealing and using his name cause he was an easy scape goat. he admited to something cause they threatened to take our daughter (which they did) she comes home in march do we have a chance of him getting off or sentence to home detention, i need him to be home with her at night when i work. he is a convicted felon that did prison time, he had a drug problem and is continuing treatment. he also cares for my 98 yr old granma while i work. i have no family or friends to watch my daughter and we have not much money for lawyer, he has a hearing on one charge 1-15-09 and trial feb9-09 and has not been assigned a lawyer by pd office. he did his intake weeks ago. i can't lose my daughter and don't know what do.

Re: home detention
The best thing you can do is move to suppress his statements to the police because they were under duress. And if there is little other evidence and no one witnessing him do the burglaries, you should have a good case.
