Legal Question in Criminal Law in Maryland
House Raid
I was involved in a house raid. My name and two other males were on the warrant. I was told that the owner or renter of the homes name had to be on the warrent and they had to be arrested. Is this true? If so why wasnt she arrested even though she was present at the time of the raid?

House Raid
The name of the owner or renter of a home to be searched does not have to have their name on the search warrant, nor do they need to be arrested. A search warrant applies to a person, place, or thing. As long as it describes what is to be search, the owner's name does not have to be listed.
