Legal Question in Criminal Law in Maryland
house raid
I was involved in a house raid where my name and two other mens names were on the warrent. I was told that the warrent had to have the person who owns, rents, or leases the house on there also. The renters name wasnt on the warrant and they werent arrested at the time of the raid even though they were present. There were drugs, a gun, a semi-large amount of money, and a crack pipe found in the residents. Shouldnt the renter be arrested also? I was found with the drugs on me. Is this ground to have my case thrown out??

Unfortunately, these are not grounds to have your case thrown out. Regardless of any mistakes that might have been made as to other people, the only thing that counts in your case is whether the police made an error as to you. If your name was on a warrant, and there was sufficient probable cause to put it there, then the police had the right to arrest you.
As to whether you could be held responsible for any drugs, guns, or other contraband that was not on your person, that depends on all the facts and circumstances of the situation.
You should also know that a possession with intent to deliver conviction carries a minimum of five to ten years jail time when there is a gun involved. My advice is to immediately retain a criminal defense attorney in your area.
Good luck to you.

You should immediately contact a defense attorney to look into the possibility of challenging this warrant.

It's hard to say from your description. You need to talk to private counsel right away. Feel free to call our offices or e-mail me directly at [email protected].

A search warrant is authority of the police to search a person, place, or thing. There is no requirement to list the owner of the residence if the owner is not to be searched. Your charges are very serious, you should consult a criminal trial lawyer, like myself, immediately.
