Legal Question in Criminal Law in Maryland
I live in Howard county Maryland. I have a neighbor that we have had issues with every since we took him to animal control. on the 27th of December he received another summons to appear for his cat. That night as my wife and I we laying in bed, we heard a loud noise. She went to the window in our bedroom and saw nothing; I went to the bedroom at the front of the house and saw this neighbor coming from the rear of my house. We got dressed and went to go inspect the house and discovered several large rocks had beed thrown at our patio and over $500 in damage was done. Can I file a civil suit for damages, since the police refuse to do anything? He lives 40-50 yards away from me and on the other side of the street. He had no reason for being on our property and was seen retreating from the property, just seconds after hearing the noise.

I never encourage anyone to file criminal charges unless it is a last resort, but this could be a situation in which you would want to go to the Commissioner and file criminal charges (Malicious Destruction of Property). You could also probably pursue a civil claim, but you'd have to ask a lawyer who handles those types of cases in the civil section of Avvo.
