Re: lying in court

Like everything else, you need evidence to prove that someone has lied under oath. The evidence could consist of an admission by the person, documents, video recordings, phone recordings, records, etc.. People lie in court lots of times, but its not easy to prove.

I would need more information to answer your second question. I am not sure about what situation you are referring to.

All the best,

David

Re: lying in court

You prove someone is lying by getting an experienced attorney to cross-examine them! And as far as speaking on behalf of your son, if you have relevant testimony, you can certainly testify. And if he is convicted, you can certainly provide mitigation.

Re: lying in court

Cross examination of a witness and compelling evidence through discovery can be used to impeach a witness or cast doubt upon the facts being presented.

Without knowing the facts it is likely that the defendant's witness is excluded under hearsay evidence.
