If aperson is questioned by police and has been mirandized before if he decides to waive his rights does he actually have to sign a paper waiving these rights and if he hasn't have those rights been violated and is the case against him dismissable

Although there is no requirement that the waiver be signed, most officers to get it signed as proof that you did knowingly and voluntarily waive your rights. Absent the signed waiver in most jurisidctions there will be a good argument that you did not waive those rights and potentially the statements made could be suppressed.

There is no requirement that a person in police custody sign a waiver of Miranda for there to be a valid waiver.
