Legal Question in Criminal Law in Maryland

Misdemeanor Theft under $500

I pleaed gulity to pawning a camera that I didn't know was stolen at the time of pawning it. The item was bought from a street vender that ofcourse was nowhere to be found once I discovered that the item was stolen , so therefore I was stuck with the charge of pawning a stolen item. My question is if I plea gulity to this charge can I still have it expunged from my record because it's stopping me from getting alot of jobs on the market?

Re: Misdemeanor Theft under $500

This depends on what your sentence was. If you received Probation Before Judgment and have had a clean record since then, you may be able to expunge after 3 years. Call an attorney to discuss more details.

I assume you did not have a lawyer when you went to court. Based on the facts you presented, a criminal lawyer would not have had you plead guilty, since the State would not be able to prove its case. If this is a district court case, and 30 days have not passed since your plea, you can appeal the decision. A conviction cannot be expunged. However if the Judge gave you probation before verdict, that can be expunged. You can get the forms for the expungement from the clerk of the court in which you received the probation before judgment.
