Legal Question in Criminal Law in Maryland

Open Container Citation in Baltimore

I recently received an open container violation in Baltimore city. I was outside for about 5 seconds because I had to go get my keys out of my friends car. Cops were outside investigating a burglary, and saw me and I received a open container citation, which is actually criminal citation. I wasnt drinking the beer nor was i drunk. what is a common fine/ penalty for this. I have nothing on my record. Should I get a lawyer, because i dont want this on my record?

Re: Open Container Citation in Baltimore

You should definitely get an attorney, because based on what you are saying, this case could very well get dismissed. If it is dismissed, you could then immediately file an expungement. If you were found guilty, the fine would typically be a few hundred dollars, depending on the judge. Most likely as a first-offender, you would be eligible for Probation Before Judgment. But under that provision, you would have to wait 3 years for an expungement.

You should consult with an attorney in more detail. I am available 24/7 if you would like to call, or you can check out my website at www.jasoncleckner.com.
