Petty Theft Sentencing
Is it normal for a first time offender with no criminal record or activity sent to sentence to jail on a Petty theft charged under one hundred dollar without given the chance to make restution?

This does not appear to be typical but is completely enforceable and legal. There must be more to this matter than you have been told. Your experience underlines why it is important to have legal representation.

If it has not been 30 days since the trial, an appeal should be taken. Most times the Judge will withhold the jail time until the appeal is over. This time use a criminal lawyer, like myself.
