possession
if drugs are found on the ground outside your car and the other person in the car admits and pleas that its there's how can I still get charged and taken to court for it?

Short answer - the police usually charge everybody, and let it all sort out in court. In Maryland, there is "constructive possession", so anyone who could have control and knowledge of the drugs can not only be charged, but convicted of possession.

Constructive possession makes this possible, but you should get a good lawyer who can explore all options for dismissal or not guilty.
