Legal Question in Criminal Law in Maryland

probation before judgement

please explain pbj..if anyone is doing a backround check will this offense show particularly in the state of maryland. i was under the impression it would not show and eventually you can have it expunged...please clarify.

I assume this is on criminal case,not DWI. Your criminal record consists of two parts, the arrest and the disposition (i.e. guilty, not guilty, dismissed etc.) A PBJ simply means no conviction was entered. But what gets a lot people confused is that there is always that record of the "arrest", which can be and is found by background investigators. This is what expungement does, erases even the arrest record and any other record such as parole and probation, adult restitution, etc. If you are going to expunge it had better a thorough expungement,not only the police arrest records but all the other collateral agencies involved. Otherwise,someone will pick up a tangential reference to the matter and dig further. Best of luck to you.
