Legal Question in Criminal Law in Maryland
Process time for being charged
My brother was arrested and held for over 72 hours before being charged. Is this legal. I was told that in MD the police have 72 to charge you. He did have an outstanding warrant, but he was arrested while in the hospital on a Saturday and charged and removed from the hospital on a Wednesday

If you have an outstanding bench warrant, you can be arrested at any time with nothing more needed. But you should contact an attorney for other possible issues with the case(s).
