can my husband and I invoke spousal privilege if were both being charged by the state?

You are only allowed to invoke spousal privilege one time. If a second case arrises, you can not do it again. Therefore, if you are both charged you can refuse to tesify using your 5th ammendment privilege against self incrimination and save your spousal privilege. Talk to a lawyer who might be able to get all charges dropped, and keep your record clean.
