Legal Question in Criminal Law in Maryland

shoplifting conviction

Hi dear Sir or Madam,

A problem has occured for a friend of min and I wanted to consult with you about it. A few days ago, she went to a store to shop and she made a huge mistake,,,

She had put 5 or 6 earings in her bag withought paying for them ! I think they were worth about 500 dollars,

That was the first time in her life that she was doing such thing and she has no previous record of any criminal act ...She was in Maryland area,,, They took her to jail for two days! then they set her free with 1000 dollars bail. They also had kept her passport ...

They gave her a court date for a few weeks from now, Now, she is very frightened and she needs my help.

Now, My questions are :

does she need to hire a lawyer for her case or the court lawyer would be good enough ?

Is this a very serious case? What do you think they would do to her ?

what do you thikn she should do since she is very very worried !

Would it be apossibility for them to put her in jail for that ?

For theft of goods worth $500 or less, the penalty is $500 and /or jail time. If she does not have the funds, the jurisdiction may provide her with a public defender. She could also hire her own attorney.

You did not indicate where the alleged shoplifting occurred. If it was in Montgomery or Prince George's County (Rockville - Bethesda - Gaithersburg - Bowie - Greenbelt - etc.), please have your friend contact me. I will be glad to assist as I have handled many such cases.

Maryland law provides for a fine and possible imprisonment. Yes, this is a serious case. With proper legal representation, if she has no criminal record and can convince the State's Attorney to treat the case as a misdemeanor rather than as a felony, it is likely that she will receive probation and a fine, rather than imprisonment. (Of course, I do not know the specifics of your friend's case so I cannot speak specifically to her situation.)

She needs an attorney. If she applied for a Public Defender and that office has agreed to represent her she is represented. Keep in mind that the PD's office represents hundreds of people and she may not get the personal representation she wants. In MD. she will not be given a lawyer on the day of trial. Even if she has no defense to the crime an attorney could help to keep her record clean.

The maximum penalty for shopplifting $500.00 or more is up to 15 years in prison. Therefore this is a serious crime. You friend should contact a criminal lawyer, like myself, now so ther is time to prepare a defense. A criminal lawyer can contact the Prosecutor and work out a deal that would keep your friend out of jail, and her record clean. But you need to give the lawyer time to do this. Therefore get a lawyer NOW.
