Legal Question in Criminal Law in Maryland

Teenager accused of having sex with teenage cousin without consent

My niece has accused my son of having sex with her when she was 13 and he was 15. They are 1 1/2 year apart. My son is now 18 and my niece is still 15.

He maintains he is innocent and she is maintaining he did it.

My sister goes Monday with her daughter to speak with the social worker.

2 years has passed since the alleged incident happend (which she maintains was approx. 6 times) and it's her word against him.

What could happen to my son? If there is no evidence other than her accusations, what could happen to him? Can he be charged and sent to jail? Will he be charged as a juvenile or adult?

Please respond as soon as you can. I have been beside myself since I found out this morning.

You son should make NO statement to anyone. He should talk to a criminal trial lawyer, like my self, now. Any statements he makes, even to a "friend" can be used against him.
