Legal Question in Criminal Law in Maryland

Telephone misuse

My daughter in law is filing false charges on me on telephone misuse. She is trying to make everybody's life

miserable including mine. I have not even cussed the woman

out. She is very well known to file in the court systems when someone does not adhere to her wishes. By the way

my son is separated from her. She also states that she has

a recording on me and I know from spyware that you can falsify any thing on those recordings.

Could you please advise.

Thank you,

Re: Telephone misuse

Penalties may apply for telephone mis-use as well as for recording of communication without permission.

Seems that each of you may have the other with an equally potent legal claim. Penalties also apply for filing court action which is frivalous and non-meritorious.

Telephone mis-use ought to be penalized. It interupts the free flow of communication and is disruptful. Other bases apply in tort as well.

Recording of coversation without permission is based on common law now part of Maryland's statute. The basis is that people ought to be able to speak freely and use of a hiden recording device is an invasion of privacy.

Contact an attorney should you require assistance with either of these matters.
