Legal Question in Criminal Law in Maryland
Do I have to Testify
My boyfriend and I had a huge fight. My mom called police we both went down to the commissioner office and put in a report. Basically they are charging him with 2nd degree assault charges. I was Subpoena to testify against him. I don't want to. Do I have to ?

Re: Do I have to Testify
Yes, but you can discuss the matter with the State's Attorney and tell them that you don't want him punished. Ultimately it's up to the State's Attorney whether to prosecute the case. If it goes to trial, you would be required to testify if subpoenaed.
