if i have no back ground would the judge conceder jail time?

Most likely not, but this depends highly on the situation, such as which judge, which prosecutor's office, and the facts of the case. But notwithstanding jail time, you also don't want a felony on your record - that would be worse than jail time. Get a lawyer!
