Legal Question in Criminal Law in Maryland
Theft over $500 and on parole
I was sentenced to 42 months in prison for unlawful taking of a motor vehicle,Theft over $500 and 2nd degree assault in 2006 served 17 months and was paroled . ^ months after my release I finally got a job and 1 month after that I relapsed on my drug addiction and caught a new Theft over $500 charge. My lawyer says that the value on said items is well below $500 and should be dropped to a misdemeanor theft. My drug addiction started from a work related back injury that put me on a steady regiment of vicodin es,percocets and oxycontins.I started this in 1996 and went all the way to 2004 when my wife demanded I stop taking these meds, so i did and ended up on street drugs.I had never been arrested prior to the charges in 2006.I honestly feel that my addiction was never addressed by the courts they just sent me to prison with no sort of education of how to cope with my addiction.I know I made stupid mistakes when Im high but honestly what options do I have to avoid Violating my Parole with this new charge

Re: Theft over $500 and on parole
You should let your lawyer do his/her best to get the charges dropped, if possible, or get a better lawyer if you feel they are not taking your situation into account. A lot of times, it's better to make the State prove their charges rather than just taking a misdemeanor offer. If you need additional assistance, contact me anytime.
